§ 1 Scope / General Information

1. These General Terms and Conditions govern the sale of products by My choice to you in the version applicable at the time of your order.

2. Any deviating terms and conditions of the customer are hereby rejected.

3. Please read these terms carefully before placing an order with My choice. By placing an order with My choice, you agree to the application of these Terms and Conditions to your order.

§ 2 Formation of the Contract

 

1. The offers are exclusively intended for end customers with a billing and delivery address in Switzerland.

2. The customer must be at least 18 years old.

3. Your order constitutes an offer to My choice to conclude a purchase agreement. The customer submits a binding offer once they have completed the online ordering process by entering the required information and clicking the button “Place order with payment obligation” in the final step of the ordering process.

4. The purchase agreement between the provider and the customer is only concluded upon acceptance by the provider. Acceptance takes place at the earlier of the following two points in time: either the dispatch of the goods or the sending of a shipping confirmation by email. Please note that confirmation of receipt of your order does not constitute acceptance of the offer.

5. The validity of contracts involving quantities exceeding normal household quantities, as well as the commercial resale of purchased goods, requires the express confirmation of the provider. This applies both to the number of products ordered within a single order and to multiple orders of the same product where each individual order corresponds to a household quantity.

6. Your orders will be stored by us after conclusion of the contract. If you lose your order documents, please contact us by email. We will send you a copy of your order data.

§ 3 Registration

 

1. Registration may only be carried out by persons over the age of 18 who reside in Switzerland. Registration is free of charge. There is no entitlement to admission to the online shop. During registration, customers must provide their official name and registered place of residence. The delivery address may be freely chosen within Switzerland.

§ 4 Prices and Shipping Costs

 

1. Our prices include the applicable statutory VAT and are exclusive of shipping costs or shipping surcharges. Shipping charges vary depending on the supplier and the nature of the product.

2. The prices published on www.itsmychoice.ch apply. All prices are stated in Swiss francs and include statutory VAT.

§ 5 Delivery and Cancellation

 

1. All orders within Switzerland are shipped via Swiss Post. International shipments are sent via Deutsche Post once a week. Shipping costs are calculated and displayed at checkout based on the delivery address provided. Please note that customs fees may apply to international shipments. Shipping costs do not include customs charges. The terms and conditions of Swiss Post and Deutsche Post apply.
   
   Estimated delivery times are as follows:
   Switzerland: A Post 1–2 working days, B Post 3–4 working days
   Europe: Up to 8 working days
    

2. My choice assumes no liability for delivery delays caused by Swiss Post or Deutsche Post.

3. Any transport damage to the shipment and/or its contents must be reported within 3 days of receipt and documented with photographs. Otherwise, the right to free replacement expires.

4. Unless otherwise agreed, delivery will be made to the delivery address provided by the customer. Information regarding product availability, shipping, and delivery times on the website represents estimates only and does not constitute binding or guaranteed delivery dates unless explicitly stated as such for the respective product.

5. If My choice determines during order processing that ordered products are unavailable, the customer will be informed by email. The customer's statutory rights remain unaffected.

6. If delivery is not possible because the goods do not fit through the customer's entrance door, front door, or staircase, or because the customer cannot be found at the stated delivery address despite having been notified of the delivery time with reasonable notice, the customer shall bear the costs of the unsuccessful delivery attempt.

7. Delivery depends on the selected payment method. For advance payment, delivery takes place after receipt of the payment instruction by the transferring bank. For credit card payments or instant bank transfers, delivery takes place after conclusion of the contract.

8. If successful delivery is impossible or significantly more difficult for reasons beyond My choice’s responsibility, My choice reserves the right to cancel the order. Any claim for damages or compensation by the customer is fully excluded.

§ 6 Payment

 

1. The customer may pay for goods using the following payment methods:
   Credit card
   Instant bank transfer

2. Certain payment methods may be excluded by the provider on a case-by-case basis.

3. Payment by cash or cheque is not permitted.

4. If the customer selects an online payment method, they authorise the provider to collect the due amount at the time of ordering.

5. If advance payment is offered and selected, the customer must transfer the invoice amount to the provider’s account within five calendar days of receiving the order. The provider will reserve the goods for this period.

6. If payment by credit card is selected, the customer expressly authorises the provider to charge the due amount after shipment of the partial delivery or complete order.

7. If the customer defaults on payment, the provider reserves the right to claim damages caused by the delay.

§ 7 Retention of Title

 

1. My choice retains ownership of the goods until full payment has been received.

§ 8 Right of Withdrawal

 

1. If the customer is a consumer, they have a right of withdrawal subject to the following provisions:

   All products are excluded from exchange. Subsequent changes to already confirmed orders are not possible.
   Defects must be reported within 3 days of receiving the products. Otherwise, the products shall be deemed accepted as faultless. Hidden defects must be reported immediately after discovery. Unfulfilled expectations regarding fragrance, texture, effectiveness, application, or possible intolerance reactions do not constitute defects and therefore do not entitle the customer to exchange or return the product.    by means of a clear statement (e.g. a letter sent by post or email) informing us of your decision to withdraw from this contract. If you exercise this right, we will immediately send you confirmation of receipt of your withdrawal (e.g. by email).

3. Consequences of Withdrawal
   If an ordered product cannot be delivered despite confirmation, the customer will be informed as soon as possible. Any payment already made will be refunded, and no replacement delivery will take place. Claims arising from non-delivery or delayed delivery are excluded. The delivered products remain the property of My choice until full payment has been received. We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.    without undue delay and no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period expires. You bear the direct costs of returning the goods.

§ 9 Data Protection

 

1. If personal data (e.g. name, address, email address) is collected, we undertake to obtain your prior consent.

2. We undertake not to pass on any data to third parties unless you have previously given your consent. Please note that data transmission over the internet (e.g. by email) may have security vulnerabilities. Therefore, complete protection of data from third-party access cannot be guaranteed. Our liability in this regard is excluded.

3. Third parties are not entitled to use contact details for commercial purposes unless the provider has previously obtained written consent from the affected persons.

4. You have the right at any time to request complete and free information from My choice regarding the personal data stored about you.

5. You also have the right to request correction, deletion, or restriction of the processing of your data.

§ 10 Cookies

​

1. To display product offers, we may use cookies. Cookies are small text files stored locally in the temporary storage of the visitor’s internet browser.

2. Many websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier consisting of a sequence of characters that allows websites and servers to identify the specific internet browser in which the cookie was stored. This enables websites and servers to distinguish an individual browser from other browsers containing different cookies. A specific browser can be recognised and identified through its unique cookie ID.

3. The use of cookies enables us to provide users with more user-friendly services that would not be possible without cookies.

4. Please note that some cookies are transferred from our server to your computer system. These are usually session cookies, which are automatically deleted from your hard drive after the browser session ends. Other cookies remain on your computer system and allow us to recognise your device during your next visit (so-called persistent cookies).

5. You can object to the storage of cookies using the cookie banner provided, where you can accept or reject cookies.

6. You can also configure your browser so that cookies are not stored on your hard drive or so that already stored cookies are deleted. Instructions for preventing or deleting cookies can be found in your browser’s help function or from the software provider.
